Terms and conditions of sale
These terms govern the contractual relationship between Mai-anh Guillou and its customers for the sale of its products.

1. Purpose and scope
These Terms and Conditions of Sale (hereinafter the “Terms”) set out the rights and obligations of the parties for the sale of the products offered by Mai-anh Guillou (hereinafter “the Seller”) to its customers (hereinafter “the Customer”).
Placing an order implies full and unreserved acceptance of these Terms. The Seller reserves the right to amend them at any time; the applicable Terms are those in force on the date of the order.
2. Identification of the seller
3. Products and prices
The essential characteristics of the products are presented on the site as accurately as possible. Photographs and descriptions are not contractually binding.
Prices are shown in euros, excluding delivery costs; VAT not applicable, article 293 B of the French General Tax Code. The Seller reserves the right to change its prices at any time; products are invoiced on the basis of the prices in force when the order is validated.
Delivery costs are added to the price of the products and are shown to the Customer before the order is validated:
- Metropolitan France — free from €200 of purchase; pick-up point €5; home delivery, tracked €8.
- European Union, Switzerland and the United Kingdom — home delivery, tracked €18.
- Rest of the world — home delivery, tracked €45.
No deposit is required: the order is paid in full when it is validated.
4. Ordering online
4.1 Ordering process
Orders are placed online in the following steps: selecting the products and adding them to the cart; checking the order summary, with the possibility of correcting any errors; accepting these Terms; final confirmation of the order, which constitutes an obligation to pay.
The sale is only finally concluded once the order confirmation has been sent to the Customer by email and, where applicable, once payment has actually been received.
4.2 Archiving and language of the contract
For any order of €120 or more, the contract concluded electronically is archived by the Seller for ten (10) years; the Customer may access it on simple request to the contact given in article 2.
These Terms and the contracts concluded on the site are drawn up in French. This English version is a translation provided for information; in the event of any difference, the French version prevails.
4.3 Refusal of orders
The Seller reserves the right to refuse or cancel any order in the event of an existing dispute, a previous failure to pay, or any other legitimate reason.
5. Payment
Payment is made online, when the order is placed, using the following payment methods: Stripe, PayPal, Apple Pay, Google Pay. Payment data is processed directly by these providers: the Seller has no access to any bank card number.
The order is payable in cash and in full on validation. It is only processed once payment has actually been received.
6. Delivery
Products are delivered to the address given by the Customer. Order preparation takes 2 working days, to which the shipping time is added:
- Metropolitan France — pick-up point: 3 to 5 working days; home delivery, tracked: 2 to 3 working days.
- European Union, Switzerland and the United Kingdom — 3 to 6 working days.
- Rest of the world — 5 to 12 working days.
These times are estimates and depend on the carrier. Risk passes to the Customer when the goods are handed over. Details of zones and rates are on the Delivery and returns page.
The Seller cannot be held liable for delays resulting from force majeure or from an act attributable to the Customer or a third party.
7. Right of withdrawal
In accordance with the French Consumer Code, a Customer who is a consumer has fourteen (14) days from receipt of the product to exercise the right of withdrawal, without having to give reasons or pay any penalty. Return costs are borne by the Customer. Returns are made exclusively by Mondial Relay, to the relay point My Golden Closet, 3 cité Rougemont, 75009 Paris.
Exceptions: in accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised, nor to goods which, once unsealed after delivery, cannot be returned for hygiene reasons. Pieces must be returned in their original condition, unworn, unwashed and with labels attached.
8. Warranties
Products automatically benefit from the legal guarantee of conformity and the guarantee against hidden defects, under the conditions provided by law.
The Seller grants no commercial warranty in addition to the legal guarantees above, which apply automatically.
Notice on the legal guarantee of conformity (article D. 211-2 of the French Consumer Code)

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish that the lack of conformity exists, not the date on which it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only needs to establish that the lack of conformity affecting the digital content or digital service exists, not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to provide all the updates needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for giving back the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for giving back the goods.
9. Liability
The Seller cannot be held liable for any indirect damage or damage resulting from improper use of the products.
The Seller is bound by an obligation of means in performing its services.
10. Personal data
Protecting your data
Personal data collected in connection with orders is processed in accordance with the General Data Protection Regulation (GDPR).

These Terms are governed by French law.
In the event of a dispute, a Customer who is a consumer may refer the matter free of charge to a consumer mediator: Centre de Médiation et d'Arbitrage de Paris (CMAP), 39 avenue Franklin D. Roosevelt, 75008 Paris, www.cmap.fr.
Failing an amicable settlement, the competent courts shall be those with jurisdiction over the Seller's registered office, subject to the legal provisions applicable to consumers.
